Information on the processing of personal data in joint controllership

In the event that Inspire GmbH and Inspire, Inc. are jointly responsible for the processing of your personal data, this is indicated in the respective section in the second part ‘Specific information’ of this Privacy Policy.

Inspire, Inc. is the manufacturer of Inspire tongue pacemakers. We, Inspire GmbH, market the product in Europe.

Both companies have entered into a joint controller agreement. This agreement specifies the joint processing activities. The agreement also regulates the respective responsibilities of Inspire, Inc. and Inspire GmbH with regard to the protection of the jointly processed personal data and how they cooperate in this regard. For example, we, Inspire GmbH, are primarily responsible for informing you about the joint processing of your personal data and handling data subject requests. Inspire, Inc. is obliged, among other things, to provide us with any necessary information and to implement any required changes to the processing of personal data that we inform them of – e.g. to delete your personal data if the lawful basis for processing no longer applies. Inspire, Inc. will also communicate with the UK’s data protection supervisory authority through VeraSafe. Both companies are obliged to ensure the security of your personal data in their respective IT environments. Furthermore, we have established general rules for handling your personal data and for the use of processors.

Transfer of data to entities outside the European Union

Should it be necessary to transfer your personal data to a third country that does not provide an adequate level of data protection, such a transfer will only take place if the applicable statutory requirements for this are met. Provided that we enter into standard contractual clauses with the recipient of your personal data in these cases, you may request a copy of these clauses by contacting our data protection officer.

However, there may be cases where it is not possible for us to implement appropriate measures to ensure an adequate level of data protection with the recipient. In such cases, the lawful basis for the transfer will be your voluntary consent, which you can give or refuse prior to the transfer (if you refuse, no transfer will take place).

In such situations, it may not be possible to fully protect your rights in the United States of America. For example, it may not be possible to prevent government access to personal information to the same extent as within the European Union or United Kingdom. It is also sometimes possible that government agencies in the United States of America may not fully comply with their information obligations. You will be explicitly informed in the respective declaration of consent whether the transfer of personal data to the United States of America is based on your consent.

Duration of data storage

We store your personal data as long as this is necessary for the purpose of processing and, in addition, as long as we are legally obliged to do so. For example, we are required by law to retain records for tax purposes and for accounting purposes. The retention periods range from six to ten years. Insofar as we are required by law to retain the data, it will be stored in a limited form for your protection and will be deleted at the end of the period in accordance with our data protection concept.

This applies equally when Inspire GmbH and Inspire, Inc. process your personal data as joint controllers.

Your rights

You have the right of access, the right to rectification, the right to erasure, the right to restriction of processing  and the right to data portability.

In addition, you have a right to object in the event of data processing based on our legitimate interests.

If you have given your consent for us (and Inspire, Inc., if applicable) to process personal data for a specific purpose, this consent is the lawful basis for the processing of your personal data. You can withdraw your consent at any time without affecting the lawfulness of the processing carried out on the basis of consent prior to your withdrawal. The withdrawal can be made informally by contacting our data protection officer.

Provision of personal data

In the context of the contractual relationship, we collect your personal data to the extent necessary for the proper performance of the contract. You are not obliged to provide any personal data. However, if you do not provide personal data, the contract cannot be fulfilled.

If you give us (and Inspire, Inc., if applicable) your consent, we (and Inspire, Inc., if applicable) will use your personal data exclusively for the purpose covered by the consent; this purpose is described in detail in the consent text. Consent is voluntary, i.e. you may or may not provide your consent and your personal data.

If the processing of your personal data is based on legal requirements, there is an obligation to provide information based on these legal requirements. In order to comply with these legal requirements, we need the necessary information from you, which may include personal data. If you do not provide the necessary information, we will not be able to establish or maintain the desired business relationship with you.

If you do not register with us or otherwise provide us with information, we only process the personal data that your browser transmits to our server. We use the YouTube video portal on our website to show you videos. We have integrated YouTube into our site via a so-called iFrame (inline frame). Google Ads

Our website uses Google Ads to display advertisements and measure their effectiveness. Meta Pixel

We use the Meta Pixel on our website. By integrating Meta Pixel, you can be shown interest-based advertisements ("Meta Ads") when you visit platforms that are owned and operated by Meta, including Facebook and Instagram. By using Meta Pixel, we aim to optimise the Meta Ads we place and tailor the content of the Meta Ads to your individual interests. We may also use Meta Pixel to track the effectiveness of Meta Ads for statistical purposes by determining whether users were referred to our website after clicking on a Meta Ad and which of our pages they visited. To do this, we set a cookie on users' browsers when they visit our website via a Meta Ad. In addition, we have integrated a so-called Meta Pixel, a JavaScript code snippet, on our website.

Calendly

Our website uses the scheduling service Calendly to enable users to book appointments online. Calendly allows users to select available time slots and submit their contact details for arranging meetings. In doing so, personal data such as name, email address and, if provided, additional information entered in the booking form may be processed. When the Calendly widget is loaded, technical data (such as IP address and browser information) may also be transmitted to Calendly. The service is used to facilitate efficient appointment management and communication.

LinkedIn

Our website uses technologies and cookies from LinkedIn to enable social media features and to support marketing and advertising activities. These cookies allow LinkedIn to recognise users, analyse interactions with our website, and measure the effectiveness of advertising campaigns.
